These Terms & Conditions apply to the supply of products and services by Vogue Blinds Pty Ltd (ACN 677 619 251, ABN 37 677 619 251), trading as Vogue Blinds (“Vogue Blinds”, “we”, “us” or “our”).

By accepting a quotation, paying a deposit, placing an order, requesting that we commence manufacture, or otherwise instructing us to proceed, you (“the Customer”, “you” or “your”) agree to these Terms & Conditions.

Nothing in these Terms & Conditions excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law (ACL) or any other applicable law.

1. Quotes and Estimates

1.1 Any instant estimate, online calculator price, verbal estimate or indicative price provided by Vogue Blinds is an estimate only and is not a final quotation.

1.2 Final pricing may depend on an in-home measure, product selection, fabric selection, dimensions, installation requirements, site conditions and any other relevant requirements.

1.3 Unless otherwise stated, a written quotation is valid for 30 days from the date of issue.

1.4 A quotation is based on the information and site conditions available to us at the time it is prepared.

1.5 We may revise a quotation before an order is accepted if measurements, quantities, product selections, installation requirements or site conditions differ from those originally provided or observed.

1.6 Any variation or additional work requested by the Customer may result in additional charges and may affect manufacturing or installation timeframes.

2. Orders and Acceptance

2.1 An order is confirmed when:

  • the Customer accepts our quotation or otherwise instructs us to proceed; and

  • the required 50% deposit has been received by Vogue Blinds.

2.2 Payment of the deposit constitutes acceptance of the quotation, product selections, specifications and these Terms & Conditions.

2.3 The Customer is responsible for reviewing the quotation and ensuring that the products, quantities, colours, fabrics and other selections shown are correct before paying the deposit.

2.4 Vogue Blinds may decline an order before acceptance where we reasonably determine that a product cannot safely or practically be manufactured or installed, the site is unsuitable, the product is unavailable, or for another reasonable commercial or safety reason.

3. Custom-Made Products

3.1 Our blinds and other window furnishings are generally custom-made specifically for the Customer's property and measurements.

3.2 Once an order has been confirmed and manufacturing or procurement has commenced, changes may not be possible.

3.3 If Vogue Blinds agrees to a requested change after an order has been confirmed, the Customer must pay any additional manufacturing, material, freight, administration or other costs resulting from the change.

3.4 Any agreed change may also extend the estimated completion or installation timeframe.

4. Deposit and Payment

4.1 A 50% deposit is required to confirm an order and commence procurement and/or manufacturing.

4.2 The remaining 50% balance must be paid in full before an installation date can be booked or confirmed, unless Vogue Blinds agrees otherwise in writing.

4.3 Vogue Blinds is not required to schedule or perform installation while any amount due under the order remains unpaid.

4.4 Where additional work or products are requested after the original quotation is accepted, Vogue Blinds may require payment for the variation before the additional work is undertaken.

4.5 All prices are in Australian dollars.

4.6 GST will be charged where applicable. The quotation or invoice will state whether the quoted amount includes or excludes GST.

5. Cancellation and Change of Mind

5.1 Because our products are custom-made to the Customer's requirements, customers should carefully review their order before paying the deposit.

5.2 If the Customer cancels an order due to a change of mind after the order has been confirmed, the deposit is non-refundable, subject always to the Customer's rights under the Australian Consumer Law.

5.3 Where manufacturing, materials, freight or other costs incurred by Vogue Blinds exceed the deposit at the time of cancellation, Vogue Blinds may seek to recover its reasonable loss or costs to the extent permitted by law.

5.4 Custom-made products cannot generally be returned or refunded simply because the Customer changes their mind, no longer wants the product, chooses the wrong colour or specification, or circumstances at the property change.

5.5 This section does not limit any right the Customer may have to a refund, replacement, repair, cancellation or other remedy under the Australian Consumer Law.

6. Measurements Taken by Vogue Blinds

6.1 Where Vogue Blinds conducts the final measure, we will manufacture the products using the measurements and relevant site conditions recorded at the time of that measure.

6.2 The Customer must inform Vogue Blinds of any planned building, renovation, repair or alteration work that may affect the windows, doors, frames, architraves, walls, floors, ceilings or proposed installation area.

6.3 Once the final measure has been completed, the Customer must not alter or replace any relevant window, door, frame, architrave or surrounding structure without first notifying Vogue Blinds.

6.4 This includes, without limitation:

  • replacement windows or doors;

  • new or altered architraves;

  • plastering or rendering;

  • tiling;

  • changes to window reveals;

  • structural modifications;

  • changes to flooring or skirting where relevant;

  • modifications affecting the dimensions or fixing location of the blind.

6.5 If the Customer or another person makes changes after our measure and, as a result, a product no longer fits or cannot be installed as originally intended, Vogue Blinds is not responsible for the resulting incompatibility.

6.6 In those circumstances, the Customer will be responsible for the reasonable costs of any required re-measurement, modification, remake, additional product, return visit and/or installation.

7. Customer-Supplied Measurements

7.1 Where Vogue Blinds accepts an order based on measurements supplied by the Customer or another third party, the Customer is responsible for ensuring those measurements are accurate.

7.2 Vogue Blinds will manufacture the product according to the measurements accepted with the order.

7.3 If the product has been manufactured correctly to the supplied measurements but does not fit because those measurements were incorrect, the Customer is responsible for the cost of alterations, replacement products, freight, re-measuring and installation.

7.4 This clause does not apply where the fitting problem was caused by an error made by Vogue Blinds.

8. Installation Requirements and Site Conditions

8.1 The Customer must provide Vogue Blinds with safe, reasonable and unobstructed access to the installation area.

8.2 Before installation, the Customer should ensure furniture, valuables, decorations and other items are moved sufficiently away from the windows and working area.

8.3 Unless specifically included in the quotation, removal, disposal, patching or repair associated with existing blinds, curtains, shutters, brackets, fixtures or other window furnishings is not included.

8.4 The Customer must advise Vogue Blinds before ordering of any known issue that could affect installation, including:

  • weak, damaged or deteriorated frames or architraves;

  • asbestos or suspected asbestos;

  • concealed electrical wiring, plumbing or services;

  • waterproofing membranes;

  • tiles or stone surfaces;

  • unusually high or difficult-to-access windows;

  • structural defects;

  • restricted access; or

  • any other unusual installation condition.

8.5 Vogue Blinds may suspend or decline installation where we reasonably believe the work cannot be performed safely or without unreasonable risk of damage.

8.6 Additional work, specialist fixings, access equipment or return visits required because of undisclosed or unexpected site conditions may incur an additional charge, which will be discussed with the Customer where practicable before the additional work proceeds.

9. Window and Building Conditions

9.1 Existing windows, walls, ceilings, floors, frames and architraves are not always perfectly square, level or plumb.

9.2 Minor visual differences, gaps or variations in the way a blind hangs or sits may occur as a result of the existing building or window condition and are not necessarily a defect in the product or installation.

9.3 Vogue Blinds is not responsible for pre-existing structural defects, deterioration or weakness in the property.

9.4 Where installation reveals a pre-existing problem, we may stop work until the Customer has arranged for the issue to be rectified.

10. Product Colours, Fabrics and Samples

10.1 Samples, photographs, website images, brochures and digital representations are intended as guides.

10.2 Actual colours, textures, patterns, opacity and finishes may vary slightly from samples or images due to manufacturing batches, lighting conditions, screen displays and the natural characteristics of materials.

10.3 Different production batches may have minor colour or texture variations.

10.4 Where matching existing blinds or products purchased at a different time, an exact colour or finish match cannot be guaranteed.

10.5 Natural fading, discolouration or changes caused by sunlight, UV exposure, heat, humidity or environmental conditions may occur over time and are not necessarily manufacturing defects.

11. Fabric Characteristics

11.1 Fabrics are flexible materials and may naturally exhibit minor characteristics such as waviness, curling, bowing, veeing, puckering, movement or variations in how they hang.

11.2 These characteristics can be more noticeable on larger blinds and do not necessarily constitute a product defect.

11.3 Blockout fabrics substantially reduce light but Vogue Blinds does not guarantee complete darkness. Light may enter around the sides, top or bottom of a blind depending on the installation type and window construction.

12. Product Availability

12.1 Product, component, fabric and colour availability may change without notice.

12.2 If a selected product becomes unavailable after an order is placed, Vogue Blinds will contact the Customer to discuss an appropriate alternative.

12.3 Where an equivalent alternative is not acceptable or reasonably available, the parties will discuss an appropriate solution consistent with applicable law.

13. Manufacturing and Lead Times

13.1 Any manufacturing, delivery or installation timeframe provided by Vogue Blinds is an estimate unless expressly agreed otherwise in writing.

13.2 Typical lead times may be approximately 2–3 weeks, but actual timeframes can vary.

13.3 Lead times may be affected by supplier availability, manufacturing delays, shipping and freight, customs, public holidays, weather, transport disruptions, product availability and other circumstances outside our reasonable control.

13.4 Vogue Blinds will take reasonable steps to keep the Customer informed of significant delays.

13.5 Nothing in this section limits any rights the Customer has under the Australian Consumer Law, including guarantees relating to the supply of services within a reasonable time where applicable.

14. Installation Appointments

14.1 Installation appointments are subject to availability and will only be booked once the payment requirements in these Terms have been satisfied.

14.2 The Customer or an authorised adult must provide access to the property at the agreed installation time unless alternative arrangements have been made.

14.3 If Vogue Blinds is unable to complete an installation because:

  • access is unavailable;

  • the Customer is not present where their presence is required;

  • the installation area has not been cleared;

  • other trades prevent installation;

  • the property or installation location has changed since measuring; or

  • another condition attributable to the Customer prevents installation,

we may charge a reasonable additional call-out or installation fee for a return visit.

14.4 If Vogue Blinds needs to reschedule an appointment due to circumstances beyond our reasonable control, we will arrange another suitable appointment with the Customer.

15. Child Safety

15.1 Vogue Blinds takes blind and curtain cord safety seriously.

15.2 Where applicable, corded internal window coverings will be supplied and installed in accordance with applicable mandatory Australian product safety requirements.

15.3 Safety devices, tensioners, cleats, warning labels and other safety components must not be removed, disabled, altered or repositioned in a manner that makes the blind unsafe.

15.4 After installation, the Customer is responsible for maintaining the safety devices and ensuring furniture, cots, beds and other climbable objects are kept away from blind cords and chains.

15.5 If a safety device becomes damaged, loose or ineffective, the Customer should stop using the affected blind where necessary and contact Vogue Blinds.

16. One-Year Vogue Blinds Warranty

16.1 In addition to any rights and remedies available under the Australian Consumer Law, Vogue Blinds provides a 12-month warranty from the date of installation or supply, as applicable, against defects in materials, manufacture and Vogue Blinds' installation workmanship.

16.2 Where a valid claim is made under our 12-month warranty, Vogue Blinds may inspect the product and, where appropriate, repair or replace the defective component or product.

16.3 The Vogue Blinds warranty does not cover problems caused by:

  • misuse, abuse, neglect or accidental damage;

  • incorrect operation;

  • failure to follow reasonable care or maintenance instructions;

  • alterations or repairs performed by anyone other than Vogue Blinds or an authorised person;

  • damage caused by children, pets or other persons;

  • water, excessive moisture or condensation where the product is not designed for those conditions;

  • fire, flood, storm or other external events;

  • building movement or structural problems;

  • damage to or failure of the window, wall, frame or architrave;

  • normal wear and tear;

  • normal fading or discolouration;

  • normal characteristics of fabrics;

  • exposure to unusual environmental conditions; or

  • damage occurring after the product has been supplied or installed that was not caused by Vogue Blinds.

16.4 Any manufacturer's warranty applicable to particular components may operate in addition to the Vogue Blinds warranty.

17. Australian Consumer Law

17.1 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

17.2 Among other things, goods supplied to consumers must be of acceptable quality, correspond with their description and be reasonably fit for any disclosed purpose where the applicable requirements of the Australian Consumer Law are satisfied.

17.3 Services must be provided with due care and skill and, where applicable, be fit for the disclosed purpose and supplied within a reasonable time where no timeframe has been agreed.

17.4 Depending on the circumstances and whether a failure is major or minor, a Customer may be entitled to remedies including repair, replacement, refund, cancellation and/or compensation as provided by the Australian Consumer Law.

17.5 The 12-month Vogue Blinds warranty is an additional warranty and does not replace or limit the Customer's statutory rights. Consumer guarantees may continue to apply after the 12-month Vogue Blinds warranty period has expired.

18. Warranty Claims and Problems

18.1 If the Customer believes there is a fault or installation issue, they should contact Vogue Blinds as soon as reasonably practicable after discovering it.

18.2 The Customer should provide:

  • their name and installation address;

  • invoice or quotation details where available;

  • a description of the problem; and

  • photographs or video where reasonably requested to help us assess the issue.

18.3 Vogue Blinds may request reasonable access to inspect an alleged defect before determining the appropriate remedy.

18.4 Customers should not arrange unauthorised repairs or modifications before giving Vogue Blinds a reasonable opportunity to inspect and address the issue, except where urgent action is reasonably necessary to prevent injury or further property damage.

19. Care and Maintenance

19.1 The Customer is responsible for using and maintaining products appropriately after installation.

19.2 Blinds should be operated carefully and only for their intended purpose.

19.3 Customers should avoid excessive force and should follow any cleaning, maintenance or operating instructions supplied with the product.

19.4 Incorrect cleaning products or methods may permanently damage fabrics, coatings or components.

20. Damage and Liability

20.1 Vogue Blinds will exercise reasonable care and skill when measuring and installing products.

20.2 To the extent permitted by law, Vogue Blinds is not responsible for loss or damage caused by:

  • pre-existing property defects;

  • inaccurate information supplied by the Customer;

  • undisclosed hazards or site conditions;

  • modifications to the property after measurement;

  • misuse or unauthorised alteration of our products; or

  • events outside our reasonable control.

20.3 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability arising under non-excludable provisions of the Australian Consumer Law.

21. Existing Property and Installation Damage

21.1 Installation ordinarily requires drilling or fixing into appropriate surfaces.

21.2 The Customer acknowledges that minor holes or fixing points are a normal and necessary consequence of installation.

21.3 Vogue Blinds will take reasonable care when performing installation but is not responsible for damage arising from concealed defects, deteriorated materials or undisclosed pipes, wiring, waterproofing or other hidden services that could not reasonably have been identified before installation.

21.4 Nothing in this section excludes liability for damage caused by Vogue Blinds' failure to exercise due care and skill.

22. Ownership of Products

22.1 To the extent permitted by law, title to products supplied by Vogue Blinds remains with Vogue Blinds until the order has been paid for in full.

22.2 Risk in installed products passes to the Customer upon installation, subject to the Customer's rights under applicable law.

23. Website and Instant Estimate Calculator

23.1 Information on the Vogue Blinds website is provided for general information and quotation purposes.

23.2 Prices generated by our instant estimate calculator are indicative estimates only and do not constitute a binding quotation.

23.3 A final price may change following measurement, inspection, product selection or confirmation of installation requirements.

23.4 We endeavour to keep website information accurate but may update products, specifications, prices, availability and other information from time to time.

24. Intellectual Property

24.1 Unless otherwise stated, website content, branding, photographs, graphics, designs, written material and other content created by or for Vogue Blinds remain the property of Vogue Blinds or the relevant rights holder.

24.2 Such content must not be reproduced or used for commercial purposes without permission, except where permitted by law.

25. Privacy

25.1 Vogue Blinds may collect personal information reasonably necessary to provide quotations, process orders, communicate with Customers, deliver and install products and provide after-sales service.

25.2 Personal information will be handled in accordance with applicable Australian privacy laws and any Privacy Policy published by Vogue Blinds.

26. Events Outside Our Reasonable Control

26.1 Vogue Blinds will not be responsible for a delay or failure caused by circumstances outside our reasonable control to the extent permitted by law.

26.2 Such circumstances may include severe weather, natural disasters, transport or freight disruption, supplier or manufacturing disruption, industrial action, government restrictions, import or customs delays and widespread service interruptions.

26.3 We will take reasonable steps to minimise the effect of such circumstances and resume performance when reasonably possible.

27. Complaints and Dispute Resolution

27.1 If a Customer has a concern, we encourage them to contact Vogue Blinds first so that we have an opportunity to investigate and resolve the matter.

27.2 Both parties agree to make reasonable efforts to resolve any dispute in good faith.

27.3 Nothing in this section prevents a Customer from exercising any statutory right or contacting NSW Fair Trading, the Australian Competition and Consumer Commission, a tribunal or a court where appropriate.

28. Changes to These Terms

28.1 Vogue Blinds may update these Terms & Conditions from time to time.

28.2 The Terms applicable to an accepted order will generally be those provided or made available to the Customer when the order was accepted, unless a change is required by law or the parties otherwise agree.

29. Governing Law

29.1 These Terms & Conditions are governed by the laws of New South Wales, Australia.

29.2 Subject to any rights the Customer may have under applicable law, the parties submit to the jurisdiction of the courts and tribunals of New South Wales.
